Hospira UK Limited and Hospira Enterprises B.V. v. Aventis Pharma S.A., District Court of Stockholm, 7 October 2011, Docket No. T 19169-10

The Hospira companies held the marketing authorization for and imported the pharmaceutical Docetaxel Hospira for Sweden. Aventis Pharam S.A. held three EP patents for Sweden and had in other jurisdictions claimed that Docetaxel Hospira infringed the EP patents (and in some jurisdictions requested and been granted ex parte preliminary injunctions). In preparation for the launch of the pharmaceutical in Sweden, the Hospira companies requested that the District Court of Stockholm should invalidate the patents for Sweden. Aventis first denied the request, referring inter alia to on-going settlement negotiations, but eventually admitted that the patents be invalidated. The only contentious issue for the Court to decide was therefore whether the Hospira companies should be reimbursed for its legal costs.

In its reasoning, the Court stated that a patent can only be invalidated by a court decision and that someone requesting an invalidity order therefore was forced to commence court proceedings irrespective of the patent holder's position. Thus it could not be considered an "unnecessary trial" for which a winning party may not be reimbursed for its legal costs under the Swedish Code of Judicial Procedure, irrespective of the fact that the writ of summons had been submitted without prior correspondence with the patent holder. Aventis was therefore order to reimburse the Hospira companies' "reasonable" costs, which was less than half of the total costs claim. The Court did not take any particular notice of Aventis' argument that it could have agreed to voluntarily cancel the patent which can be done by application to the Swedish Patent and Registration Office).?

EL PASO, Texas (AP) ? A retired British businessman accused of plotting to sell missile components to Iran headed to the United States Friday to face charges after failing to overturn an extradition order.

Christopher Tappin faces charges in El Paso, Texas, that he tried in 2006 to buy specialized batteries for Hawk missiles for $25,000 from undercover American agents with the intention of exporting them to Iran.

The 65-year-old Tappin faces up to 35 years in jail if convicted. He fought extradition for two years until last month when he was denied a petition to take the case to Britain's Supreme Court. A subsequent appeal to the European Human Rights Court was also rejected.

Tappin denies any wrongdoing, saying he was the victim of a sting operation.

The order to deport Tappin sparked a debate in the U.K., where critics claim the country's extradition treaty with the U.S. does not provide equal protection for British and American citizens.

Prime Minister David Cameron has promised to carefully review the treaty and a recent independent study on its balance. That report, conducted by Lord Justice Scott Baker, largely endorsed the treaty and the overhaul demanded by many of the deal's critics doesn't appear to be in the cards.

U.S. Marshalls took Tappin into custody Friday morning at London's Heathrow Airport. He complained to reporters that he was receiving harsher treatment than Abu Qatada, a radical, Jordanian-born cleric accused of ties to al-Qaida who recently received bail in London.

"I have no rights," Tappin said as his wife looked on in tears. "Abu Qatada is walking the streets of London today and we cannot extradite him. He has more rights than I have. If I was a terrorist, I would not be going to America. I think it's a shame, a disgrace."

He was expected to arrive in Texas on Friday afternoon.

Tappin's attorney, Houston based attorney Dan Cogdell said he will aggressively seek bond.

"He is not a flight risk, not a terrorist, not a danger," Cogdell said. He declined to comment further.

Tappin was accused in a 2007 three-count indictment of scheming to export the batteries to the U.K. without a license. Court documents show that a cooperating defendant provided computer files that demonstrate Tappin intended to then send the batteries to a Tehran-based company and that he and the cooperating defendant had illegally sold U.S. technology to Iran in the past.

Two other men have already been sentenced to prison times for charges stemming from the indictment. Robert Gibson, another British national, pleaded guilty in April 2007 and was sentenced to 24 months in prison. Robert Caldwell, from Oregon, was found guilty in July of that year and received a 20 month sentence.

Updated at 9:50 a.m. ET: KABUL, Afghanistan?-- President Barack Obama has written a letter to his Afghan counterpart?apologizing for the burning of copies of the Quran at a NATO military base in the country. Two U.S. soldiers were also shot dead Thursday?at a protest about the desecration of the holy books.

A man wearing an Afghan government soldier's uniform?killed the American troops and wounded four others at the demonstration in?Nangarhar province,?officials told NBC News.

There have been violent protests daily since it emerged on Tuesday that Qurans used by detainees held at the Bagram military base had been burned. The incident has become a public relations disaster for foreign forces in Afghanistan.

A statement from President Hamid Karzai's office said the U.S. ambassador to Afghanistan had delivered the letter from Obama Thursday.

Taliban to Afghans: Kill foreigners over Quran burnings

In the letter, which is quoted in the statement, the U.S. president expressed his "deep regret for the reported incident" and offered his "sincere apologies."

According to the statement, Obama wrote: "The error was inadvertent; I assure you that we will take the appropriate steps to avoid any recurrence, to include holding accountable those responsible."

Angry afghans attacked U.S. bases after reports of Quran desecration.

Tommy Vietor, a spokesman for the National Security Council, told NBC News that Obama had "expressed our regret and apologies over the incident in which religious materials were unintentionally mishandled at Bagram air base."

The?Quran burnings at the vast Bagram base could make it even more difficult for U.S.-led NATO forces to win the hearts and minds of Afghans and bring the Taliban to the negotiating table ahead of the withdrawal of foreign combat troops by the end of 2014.

Muslims consider the?Quran the literal word of God and treat each book with deep reverence. Desecration is considered one of the worst forms of blasphemy.

General John Allen, commander of the International Security Assistance Force (ISAF),?on Tuesday?offered his "sincere apologies" for the burnings. "When we learned of these actions, we immediately intervened and stopped them," he added. "This was not intentional in any way."?

The deadly?protest in Nangarhar was one of several across the country on Thursday.

Riots triggered by the inadvertent Quran burning at a U.S. military base prompted the U.S. to lock down its embassy. NBC's Atia Abawi reports.

According to?Haji Mohammad Hassan, the deputy police of Khogayani district in Nangarhar province, American soldiers had starting firing at protesters who were attacking their base.

He said that an Afghan soldier then turned his weapon on the U.S. troops, shooting six, killing two and injuring four.

Hassan said the Afghan soldier escaped by joining the crowd of protesters. However,?a provincial official, who asked not to be named, said the shooter had been killed after the attack.

The Taliban have claimed responsibility for the attack, NBC News reported.?

Taliban spokesman Zabiullah Mujahid said in a text message that they infiltrated the army with one of their fighters who?had shot and killed the Americans. Mujahid claimed that their?insurgent killed 10 Americans.

The fourth and final stop on the indoor Visa Championship Series, the meet will be broadcast on ESPN on Sunday, February 26, from 7:30-9:30 p.m. Eastern. Spots will be on the line for Team USA for the World Indoor Championships, which will be held March 9-11 in Istanbul, Turkey.

World leader Madison taking it to the track
Madison is best known for sprinting down the long jump runway, but this year the 2005 world long jump champion is turning heads with her times on the track. Madison owns three of the four fastest times in the world this year in the 60m. At the USATF Classic, Madison ran the world leader in the prelims and came back to improve it again in the finals to 7.02. Madison is currently second (behind Jenn Suhr) in the overall standings in the race for the Visa Championship Series title. But Madison will have to fight to claim her first USA title on the track. Reigning indoor champion Alex Anderson and two-time indoor champion Me?Lisa Barber are two of the top challengers in the 60m along with 2006 World Indoor silver medalist Lauryn Williams.

Richards-Ross on a roll
While Richards-Ross struggled with ups and downs in 2011, she has been on a winning streak so far for 2012. In her first season of indoor competition since 2006, Richards-Ross has been victorious in all three races she has entered this year, including running the world leading time of 50.89 with her win at the Millrose Games. The top challenger in the 400m will be DeeDee Trotter, who sits at No. 2 on the U.S. list and is also undefeated for the year. Trotter picked up a win earlier in the Visa Championship Series with her win in the 300m at the New Balance Indoor Grand Prix. Natasha Hastings will also be looking for the win as she looks to defend her 2011 indoor title.

Simpson defends double
Reigning 1500m world champion Jenny Simpson is entered in both the 1500m and 3,000m. At last year?s edition of the Indoor Championships, Simpson successfully completed the double to win both national titles. Simpson recently won the 1500m at the Millrose Games to garner the top seed time of the field at 4:07:27. Simpson?s top challenger in the 1500m will be Brenda Martinez, who has been on a roll this indoor season after winning the U.S. Open and finishing as the top American at the USATF Classic.

In the 3,000m, Simpson will face Sara Hall (Montgomery HS, Santa Rosa 2001; Stanford 2005)who has finished as the USA Indoor runner up the past three times in this event. Hall has recent wins under her belt with the USA Cross Country title and the Pan Am Games steeplechase title.

In other events, Kristi Castlin is the top entrant in the women?s 60m hurdles with reigning world champion Lolo Jones unable to compete due to a hamstring injury. The women?s 800m should be a close battle with Phoebe Wright, Erica Moore and Latavia Thomas all entered with marks under 2:03. In the women?s 3,000m race walk, the two-time defending USA Indoor champion Maria Michta will face veteran Joanne Dow who has five USA Indoor titles to her name.

Colt Rosensweig tells the story of beloved Michigan gymnastic ...

Well before she graduated from Menlo-Atherton High School and went off to attend the University of Michigan, Colt Rosensweig had a passion for sports and a dream of becoming a sports writer. Topping her sports list was baseball. In fact, she decided to attend Michigan because it was close to her beloved Detroit Tigers.

As often happens in life, there are twists and turns. As a job requirement to be a baseball beat writer for the Michigan Daily, she had to also cover two ?lesser? sports. One of those sports was gymnastics, and Colt was instantly hooked.

?The second year I was covering the gymnastics team, I decided I really wanted to immerse myself in all the team?s activities, so I started going to practice,? she said during a conversation at Burgess Park with two dogs at her side (more about that to come!). ?About once a week, the retired gymnastics coach Newt Loken would come and watch practice, too.?

?We?d sit together and he was such a fun guy. You couldn?t be around Newt and not be smiling. He knew everybody and regaled in the art of story telling. You could really see why he had touched so many lives. His athletes viewed him as a second father, not a a drill sergeant coach.?

The result of those conversations and many more over the ensuing years are captured in the book Newt: The Father of Michigan Men?s Gymnastics, just published by Huron River Press. Colt will be signing books at Kepler?s on Saturday, Feb. 25 from 3:00 to 5:00 pm and promises a special surprise around 4:00 pm. (Hint: the Michigan men?s gymnastic team is in town for a meet against Stanford.)

Given that Colt is now a published author and the book is about sports, one might presume that she?s on to more sports writing. Wrong. Colt is actively pursuing a career as a dog walker, sitter, and trainer, plying her trade mainly on the streets of Menlo Park.

?I really love it,? she said, with dogs Juno and Charlie at her side. ?I?ve been training with Freddie Jackson, who is a well-regarded local trainer. Of course, people are telling me to write a dog book. But, I think I need to have a lot more adventures. That was what was great about Newt, he had so many great stories!?

The soldiers have chosen to ignore the villager's cries for help, this is where you come in. Slay the beast to save the villagers. If that doesn't temp you then do it for the gold. difficulty: 1 star. Risk level: Medium

Two star missions: Men have been disappearing from a main research facility in Nosit. The wives and female report hearing a strange song, soon after the men wander off never to be seen again. It is there idea that a Lamia or a pack of Lamia are behind it all. Find and deal with the Lamia. Save the men if any are still alive for a bonus to your reward, though it is not required to do so. difficulty: 2 star. Risk level: High

The New York Knicks sensational point guard Jeremy Lin has quietly sought trademark protection for "Linsanity" as well as for his name, according to records on file at the US Patent and Trademark Office.

According to application 85541426, Lin filed for trademark protection on both last Monday.?Pamela Deese, an intellectual property lawyer at?the Washington, D.C., law firm?Arent Fox who is listed as the attorney of record, confirmed that Lin was behind the filing.?

Among the items Lin has sought protection for use of the term are: Clothing, namely, shirts, T-shirts, sweatshirts, hooded sweatshirts, jackets, hooded jackets, coats, headbands, sports jerseys, nightshirts, pajamas, pants, rain coats, rain wear, robes, scarves, shorts, socks, sweaters, sweatpants, underwear, warm-up suits, wristbands, sweatbands, belts; footwear, namely, shoes, slippers, sandals, athletic footwear, sneakers; headwear, namely, caps, hats, visors and bandanas.

Two California men who are not associated with Lin have sought the Linsanity trademark as well.

The application process starts with the examining attorney?s review and approval. The mark then is published for 30 days and any parties that believe they may be harmed can file opposition. Lin can (and is likely to) contest the others' applications.

Social Media: A Love Story ? Culture and Social Media Technologies

As I perused the Internet for the perfect article to analyze, I was disappointed with my findings.? All of the articles I encountered offered lists of reasons why social media would ruin relationships, and although it is true that relationships in the social media realm are not always rainbows and unicorns, I was determined to find an article that was more than a laundry list of social media?s detriments.

I then came across the article ?Tweeting Ur Luv on #Vday? and was instantly hooked by its playful title.? To my delight, the title was not the only impressive aspect of the article, for the text and embedded video were up to par as well.

I first watched the video titled Social Media Saves Valentine?s Day, which was produced by Socialnomics author Erik Qualman.? Although this video did demonstrate a failed relationship due to social media, it did it in a fun, exciting way, which actually highlighted many of the benefits of social media.? Because of the high-speed qualities and sense of community exemplified by social media, this man was able to pull off a Valentine?s Day that was too good.? This light and positive representation of social media continued throughout the article.

In addition to its optimistic approach, I also really enjoyed the article?s well roundedness.? Instead of focusing on one specific couple, writer Bob Strauss references couples that reconnected on Facebook, a single woman without a Facebook, Twitter feeds, and other online communities to portray social media?s affect on Valentine?s Day.

Strauss speaks of two couples that were old friends before reconnecting on Facebook that eventually turned into romantic partners.? Strauss emphasizes the importance of social media?s impact on sustaining these relationships, but what I would have liked to know more about was how the early reconnection had gone about.? Donath and boyd say in their article ?Public Displays of Connection?, ?the public display of connections found on networking sites should ensure honest, self-presentation because one?s connections are linked to one?s profile? (74 Donath and boyd).? How did these couples find each other on Facebook? Did they actively seek each other out or did they stumble upon one another by chance going through a mutual friend?s network?? Were the ways the other person was depicted on Facebook representative of the old friend they remembered, or were new aspects of this person?s identity on display for them to learn? I think it would have been interesting to know a little bit more about the beginning stages of these couples? interactions.

Strauss also presented a counterargument to social media?s relationship benefits by offering Amanda Taylor?s ?social media is the devil? opinion (Strauss 1).? Not only did I like the way this opinion downplayed the article?s optimistic skew, it also served as lead-in to a community of girls who are alone on Valentine?s Day, Single Girl Problems.? This Twitter feed perfectly demonstrates Baym?s attributes of online communities such as sense of space, shared practice, and shared identities.? It is a place where single girls who feel alone go to feel not so alone anymore.? They identify with each other while submitting their own ?single girl problems,? and gain emotional support within this social space, which Baym defines as,?the ability to turn to others for comfort and security during times of stress, leading the person to feel that he or she is cared for by other,? (Baym 83).? There is a ?shared sense of who ?we? are? and different users assume different roles, as I would assume there are definitely some ?lurkers? hanging around Single Girl Problems (Baym 86-87).? Strauss mentions other websites that typify Baym?s five characteristics of online communities such as, Cheaterville, Cupidville, and Karmaville as well.

As opposed to the film Life 2.0 this article presents its story with a much lighter connotation.? Life 2.0 dramatized each storyline it followed.? Whether the users were depicted as creepy, psychologically damaged, or even as part of a community, each scenario was seen as extreme.? This article is quite the opposite, showing a multifaceted view of social media.? One woman quoted in the article says, ?I use social media to say Happy Valentine?s to all of my friends and family,? but she also distributes candy to her co-workers because she, ?wants them to know that they have a real friend? (Strauss 1). The juxtaposition of using social media, and acknowledging her ?real? friends shows that there are no extremes depicted in this article.

After looking at all sides of the spectrum, the article has a slightly optimistic tone and seems to conclude social media has a positive affect on relationships by bringing people together.? Overall I think the article did a great job at assessing the situation from all angles?he examined different platforms, different types of relationships, and different outlooks?and left the reader with a substantial understanding of the different realms of social media and their affect on Valentine?s Day.

Four TCU football players arrested for selling drugs (Reuters)

FORT WORTH, Texas (Reuters) ? Four Texas Christian University football players, including one All-American, were among 17 students arrested Wednesday morning as a result of a six-month investigation into illegal drug dealing on the Fort Worth campus.

The investigation is continuing and more student arrests are possible at the university, which has an enrollment of about 9,500, Fort Worth police and university officials said at a news conference on Wednesday.

Police said later Wednesday that one additional person was arrested for drug possession during the roundup. Police did not immediately say whether the 18th person arrested was a student.

The football players arrested were junior linebacker Tanner Brock, junior defensive tackle David "D.J" Yendrey; junior safety Devin Johnson and sophomore offensive tackle Ty Horn.

Brock is a standout player who was named a Phil Steele third-team All-American and a SportsIllustrated.com honorable-mention All-American. He registered nine tackles, including five solo tackles, in TCU's 21-19 win over Wisconsin in the 2011 Rose Bowl.

The 17 students arrested had sold drugs "hand-to-hand" to undercover officers, TCU Police Chief Steve McGee said. Drugs sold to officers included marijuana, cocaine, ecstasy and a variety of prescription drugs.

The four football players are accused of selling marijuana to officers.

The investigation was prompted by complaints from students, parents and community members, officials said.

The arrested students were immediately removed from campus and face possible expulsion, officials said.

"TCU has never before experienced a magnitude of student arrest such as this," Chancellor Victor Boschini said in a statement. "In fact, campus police records show only five student arrests related to drug law violations in recent years."

Fort Worth Police Capt. Ken Dean said three of the 17 students were arrested on campus and the rest were arrested off campus.

Boschini said this is not a football problem but a student problem.

The TCU Horned Frogs football team has been one of the best in the nation in recent years and finished the 2011 season ranked No. 13 in the USA Today poll. TCU is set to join the powerful Big 12 Conference in July.

"As I heard the news this morning, I was first shocked, then hurt and now I'm mad," TCU head football coach Gary Patterson said in a statement.

Obama adviser: Santorum takes 'divisive positions'

WASHINGTON (AP) ? A top adviser to President Barack Obama's re-election campaign says Republican presidential candidate Rick Santorum has taken "divisive positions" on key social issues.

David Axelrod tells "CBS This Morning" he believes voters don't yet know Santorum very well. And he declines to speculate on how tough a race the former Pennsylvania senator could give Obama.

Axelrod says when people begin to look closely at Santorum's positions, "we'll get a better idea" of how well he'll do. The former White House adviser also says the GOP race has been overcome by "negativism" and that has a "dispiriting" impact on voters.

As for the Obama re-election campaign, Axelrod says: "We don't get exhilarated by good numbers. We're not devastated by bad poll numbers. We just stick to our knitting and keep going."
