Bioinspired fibers change color when stretched

Jan. 28, 2013 ? A team of materials scientists at Harvard University and the University of Exeter, UK, have invented a new fiber that changes color when stretched. Inspired by nature, the researchers identified and replicated the unique structural elements that create the bright iridescent blue color of a tropical plant's fruit.

The multilayered fiber, described January 28 in the journal Advanced Materials, could lend itself to the creation of smart fabrics that visibly react to heat or pressure.

"Our new fiber is based on a structure we found in nature, and through clever engineering we've taken its capabilities a step further," says lead author Mathias Kolle, a postdoctoral fellow at the Harvard School of Engineering and Applied Sciences (SEAS). "The plant, of course, cannot change color. By combining its structure with an elastic material, however, we've created an artificial version that passes through a full rainbow of colors as it's stretched."

Since the evolution of the first eye on Earth more than 500 million years ago, the success of many organisms has relied upon the way they interact with light and color, making them useful models for the creation of new materials. For seeds and fruit in particular, bright color is thought to have evolved to attract the agents of seed dispersal, especially birds.

The fruit of the South American tropical plant, Margaritaria nobilis, commonly called "bastard hogberry," is an intriguing example of this adaptation. The ultra-bright blue fruit, which is low in nutritious content, mimics a more fleshy and nutritious competitor. Deceived birds eat the fruit and ultimately release its seeds over a wide geographic area.

"The fruit of this bastard hogberry plant was scientifically delightful to pick," says principal investigator Peter Vukusic, Associate Professor in Natural Photonics at the University of Exeter. "The light-manipulating architecture its surface layer presents, which has evolved to serve a specific biological function, has inspired an extremely useful and interesting technological design."

Vukusic and his collaborators at Harvard studied the structural origin of the seed's vibrant color. They discovered that the upper cells in the seed's skin contain a curved, repeating pattern, which creates color through the interference of light waves. (A similar mechanism is responsible for the bright colors of soap bubbles.) The team's analysis revealed that multiple layers of cells in the seed coat are each made up of a cylindrically layered architecture with high regularity on the nano- scale.

The team replicated the key structural elements of the fruit to create flexible, stretchable and color-changing photonic fibers using an innovative roll-up mechanism perfected in the Harvard laboratories.

"For our artificial structure, we cut down the complexity of the fruit to just its key elements," explains Kolle. "We use very thin fibers and wrap a polymer bilayer around them. That gives us the refractive index contrast, the right number of layers, and the curved, cylindrical cross-section that we need to produce these vivid colors."

The researchers say that the process could be scaled up and developed to suit industrial production.

"Our fiber-rolling technique allows the use of a wide range of materials, especially elastic ones, with the color-tuning range exceeding by an order of magnitude anything that has been reported for thermally drawn fibers," says coauthor Joanna Aizenberg, Amy Smith Berylson Professor of Materials Science at Harvard SEAS, and Kolle's adviser. Aizenberg is also Director of the Kavli Institute for Bionano Science and Technology at Harvard and a Core Faculty Member at the Wyss Institute for Biologically Inspired Engineering at Harvard.

The fibers' superior mechanical properties, combined with their demonstrated color brilliance and tunability, make them very versatile. For instance, the fibers can be wound to coat complex shapes. Because the fibers change color under strain, the technology could lend itself to smart sports textiles that change color in areas of muscle tension, or that sense when an object is placed under strain as a result of heat.

Additional coauthors included Alfred Lethbridge at the University of Exeter, Moritz Kreysing at Ludwig Maximilians University (Germany), and Jeremy B. Baumberg, Professor of Nanophotonics at the University of Cambridge (UK).

This research was supported by the U.S. Air Force Office of Scientific Research Multidisciplinary University Research Initiative, by the UK Engineering and Physical Sciences Research Council, and through a postdoctoral research fellowship from the Alexander von Humboldt Foundation. The researchers also benefited from facilities at the Harvard Center for Nanoscale Systems, which is part of the National Nanotechnology Infrastructure Network supported by the U.S. National Science Foundation. The Wyss Institute for Biologically Inspired Engineering at Harvard also contributed to this research.

Russia warns Israel, West against attack on Iran

MOSCOW (Reuters) - Russia warned Israel and the West on Wednesday against any military strikes on Iranian nuclear facilities but suggested Tehran should be quicker to cooperate over inspections of its nuclear sites.

Speaking at his annual news conference, Russian Foreign Minister Sergei Lavrov mixed words of caution over isolating Iran or attacking it with a gentle nudge to Tehran over the inspections by the International Atomic Energy Agency.

"Attempts to prepare and implement strikes on Iranian nuclear facilities and on its infrastructure as a whole are a very, very dangerous idea. We hope these ideas will not come to fruition," Lavrov said.

Israeli Prime Minister Benjamin Netanyahu has hinted strongly at possible military action to stop Iran from developing an atomic bomb. In an election victory speech on Wednesday, he said preventing Iran from obtaining nuclear weapons would be the main challenge for a new government.

Referring to talks in which the IAEA has been trying to negotiate an agreement for inspectors to gain access to sites, officials and documents, Lavrov said: "The Iranians have said they want this document to be agreed in full. We think our Iranian colleagues could do this a little bit faster."

Speaking of separate negotiations between Iran and six world powers that are trying to ensure it does not pursue a nuclear weapons program, Lavrov said he was confident a new round of talks would be held but said a venue had not yet been agreed.

Iran denies it is trying to develop a nuclear arsenal and says its nuclear program has only peaceful purposes.

Court overturns sex offender Facebook ban

An Indiana law barring sex offenders from joining social and online?networks like Facebook,?Twitter and various chat rooms was ruled unconstitutional by a federal appellate court Wednesday.

Judges with the 7th Circuit Court of Appeals in Chicago said that the law, passed in 2008, violates the First Amendment in that it is too broad a ban.

"Laws that implicate the First Amendment require narrow tailoring," ?the judges said in a written decision. "Subsequent Indiana statutes may well meet this requirement, but the blanket ban on social media in this case regrettably does not."

A Facebook spokesman told NBC News Wednesday that sex offenders already are?barred from using Facebook, and that the social network's internal teams monitor the site for such activity.

The ACLU had challenged the ban, saying that even though the law was meant to protect children from online?sexual predators, social networks and other sites have become so vital to Americans that a total ban would prevent sex offenders from using sites for legitimate reasons, including business and religious activities.

The 7th Circuit's ruling overturned a U.S. District Court ruling in favor of the ban.

THE RESET: Obama now must move on 2nd-term agenda

President Barack Obama now faces the heavy lifting of trying to move ahead on the lofty second-term vows and declarations he laid out in his inaugural address.

He presented a muscular retooled agenda that includes addressing climate change, controlling health care costs, advancing gay rights and tax fairness, overhauling the immigration system and curbing gun violence. And it comes amid a series of looming new fiscal fights.

The president will outline specifics in his State of the Union address Feb. 12.

The day after his second and final inauguration, Obama on Tuesday attended the National Prayer Service at Washington National Cathedral. He did not speak.

He and first lady Michelle Obama also were to preside over a final inaugural ball in the evening for White House and campaign staffers. It was to feature singer Lady Gaga.

Meanwhile, the House is to vote Wednesday on a GOP leadership-proposed measure that could keep the government ? temporarily ? from running out of borrowing authority.

The government already has hit its $16.4 trillion debt ceiling, and Treasury Department officials say ways to pay all the bills will be used up as early as mid-February. The congressional measure would suspend the debt ceiling until May 17, and it appears to have wide support in both House and Senate.

Meanwhile, leaders of both parties are urging political reconciliation.

Senate Majority Leader Harry Reid, D-Nev., denounced the "sharp political divides" of the last Congress and said in a Senate speech that he hoped the new 113th Congress "will be characterized not by our divisions but by our renewed commitment to cooperation and compromise."

Senate Minority Leader Mitch McConnell, R-Ky., said, "Republicans are eager to work with the president" on achieving common goals. And House Speaker John Boehner, R-Ohio, said it's time to "renew the old appeal to better angels."

The 4 Basic Financial Accounts Everyone Should Have

At my other job, I write about food. Just as personal finance writers often return to favorite topics like Roth IRAs and not buying expensive coffee, every food writer eventually writes about their recommended basic set of kitchen tools.

If you haven?t read one of these articles recently, you can guess what goes into the toolbox: basics like a knife, a saucepan, a wooden spoon, and a Pyrex measuring cup.

You can?t cook literally everything with those items, but you can cook enough great food to keep your mind off a $1600?solid brass duck press?for a while. Maybe forever.

Your basic set of financial accounts can be nearly as simple. Here?s the starter kit everyone needs.

You may need more accounts on top of these, and you might even get by with less, but start here and use this as a checklist.

If you?re missing an account on the list, think about whether opening one would make your finances simpler or more secure.

If you have a bunch of accounts not on the list, well, it might be time to get out that chef?s knife and start chopping.

The basic four

1. A checking account for paying bills

Your paycheck gets deposited here, along with any other income.

From this account you?ll pay your housing, car, utility, insurance, school tuition, and any other bills that show up every month (or less). You?ll also set up an automatic transfer from this account to?

2. A checking account for daily spending

This can be at the same bank as account #1 or a different bank. Since the only deposits will be coming in from account #1, this is a good candidate for opening at an online bank.

This account is for daily spending on groceries, entertainment, dining out, minor household items, and so on. You can spend this account down to nearly zero, knowing it will be regularly replenished from account #1.

Why two checking accounts, when I said this was about simplifying?

Because in my experience, switching from a single spending account to two separate spending accounts with different purposes had an immediate positive effect on my family?s finances.

We went from worrying about why the checking account was always empty to knowing exactly how much we could spend without endangering our ability to pay upcoming bills.

And because you can add both accounts to Mint and see the balances anytime, it?s not much more trouble than a single account.

3. An emergency fund

This will most likely be an?FDIC-insured savings account, ideally one that pays a little interest (no bank account pays more than a little interest these days) and is not too easy to get to.

An online bank where it takes two or three days to get the money should be fine. Few emergencies require a large amount of cash immediately.

Your emergency fund is there to cover unexpected medical bills, car repairs, or unemployment.

Why keep it in a separate account? Because if you keep it in account #1 or #2, you?re more likely to spend it on a non-emergency. Don?t even try to deny it.

You can squeeze out a little more interest without taking additional risk by getting creative with your emergency fund.?Here are a few ideas.

4. A retirement account

This could be a 401(k), an?IRA?or Roth?IRA, or any of the rest of the alphabet soup of lesser-known retirement accounts.

Most families will end up having multiple retirement accounts (one spouse?s 401(k), the other spouse?s Roth?IRA, and so on), but one is infinitely better than none.

One more for the self-employed

If you?re self-employed, first of all, your retirement account should be one designed for self-employed people, such as a?Solo 401(k). You?ll also need one more account to keep yourself out of tax trouble:

5. A quarterly tax account

If you work for a boss and receive a W-2, your income and Social Security/Medicare taxes are automatically withheld from your paycheck. If you work for yourself, no such luck.

Plenty of freelancers and small business owners shoot themselves in the financial foot every year by failing to pay their quarterly taxes.

Everyone who pays quarterlies should accumulate the money in a separate account designated for the purpose, and should set aside a portion of every check.

You can connect that account directly to the?IRS?via?EFTPS.gov?and pay online in seconds.

What?s missing?

Notice what?s missing from the list??An old-fashioned non-emergency savings account.

A savings account can be handy for saving up for short- to medium-term goals, but the best interest checking accounts pay nearly as much interest as savings accounts.

The savings account at one major online bank, for example, pays 0.95% interest, while the checking account pays 0.75%.

And?reward checking accounts?can pay more than any savings account, if you follow the rules.

Now, with that out of the way, what should I make for dinner? I have an idea, but it involves $1600 and a very unhappy duck.

We probably didn?t need this kind of iron-clad confirmation to know that Freddy Adu was done with the Philadelphia Union ? but we got it anyway.

Not everyone agrees, but I personally enjoy this type of candor from those in power.

In a letter to fans this morning, Union manager John Hackworth has provided confirmation (as we speculated late last week) that Adu?s days at PPL Park are, indeed, numbered.

In theory, one could contest that public acknowledgement of this decision makes a move more difficult, or diminishes the potential financial return.

But, honestly, who?s kidding whom here? Adu was barely a part of the team late last year under Hackworth. Everybody noticed. Slumping pigment demand eats into DuPont's profit

fourth-quarter profit, with Chief Executive Officer Ellen Kullman tempering expectations for those once-lucrative markets due to "significant challenges."

Demand fell most for DuPont's titanium dioxide pigment, which is found in products ranging from car paint to sunscreen. In 2012, that unit's share of the company's overall profit declined to 28 percent from nearly a third in 2011.

"We've adjusted our plans to meet the changing market environment and grow our businesses in a slow-growth world economy," Kullman said in a statement on Tuesday.

The company's results did beat Wall Street expectations, mainly because of strong sales of food and plastics. That helped boost DuPont's shares 1.1 percent to $47.51 in premarket trading.

The company posted net income of $111 million, or 12 cents per share, down from $373 million, or 40 cents per share, a year earlier.

Excluding one-time items, DuPont earned 7 cents per share. By that measure, analysts expected 11 cents, according to Thomson Reuters I/B/E/S.

Net sales fell less than 1 percent to $7.33 billion. Analysts had expected $7.26 billion.

DuPont said "softness" in the solar panel market had dented sales. The company supplies pastes and other parts needed to build panels.

DuPont said it expected to earn $3.85 to $4.05 per share in 2013, while Wall Street expects $3.84.

The company forecast 2013 sales of $36 billion, compared with analysts' estimates of $35.9 billion.

Wilmington, Delaware-based DuPont is the most valuable U.S. chemical maker, as measured by market capitalization.

Obama?s inaugural surprise: His own Crossroads GPS

On the eve of President Barack Obama?s inauguration has been a quiet move to extend his campaign apparatus in the form of a social media Crossroads GPS-like group.

obama1231The Los Angeles Times first picked up on the story on Thursday, followed by Politico. President Obama confirmed the move on Friday, which comes in the form of setting up a 501(c)(4) nonprofit called Organizing for Action.

The Supreme Court?s Citizens United decision in 2010 allows corporations to donate unlimited sums of money to such groups, without their names being made public. On Friday, a White House source told BuzzFeed that Organizing for Action will voluntarily disclose the names of its donors.

Ironically, such 501(c)(4) groups were criticized by the Obama campaign during the 2012 election season, even though there was one group associated with the Obama camp.

The efforts of bigger 501(c)(4) groups like Karl Rove?s Crossroads GPS were more effective at raising large amounts of money?and received heavy criticism from Democrats.

But in the end, President Obama?s social media/marketing machine, based in Chicago, was more effective at spending money and getting out the vote against GOP contender Mitt Romney.

So now, the remnants of that machine will become Organizing for Action and its leadership group will reportedly include such Obama heavy-hitters as Jim Messina (the Obama re-election campaign?s manager), Stephanie Cutter, Robert Gibbs, and David Plouffe.

Vice President Joe Biden dropped hints last week the group will tackle gun control as its first issue.

And when it comes to Organizing for Action, its advocacy of issues will be key to maintaining its nonprofit status.

The primary purpose of a 501(c)(4) group is to engage in the ?promotion of social welfare.? That would include TV ads and social media campaigns about gun control, immigration, or other issues, but not ones targeting politicians or elections.

The PBS series Frontline has a good explanation about how a 501(c)(4) group can be used by smart political operators. It explains that much like George Carlin?s ?Seven Words You Can?t Say on Television,? there are eight words or phrases that a 501(c)(4) can?t use in an ad.

By avoiding the words which are directly related to election campaigns, a group like Organizing for Action can run as many TV and social media campaigns as it can afford (or sees fit to run without annoying too many people).

In an email on Friday to supporters obtained by Politico, President Obama laid out the issues that Organizing for Action will address.

?We?ve got to keep working on growing the economy from the middle out, along with making meaningful progress on the issues we care about ? immigration reform, climate change, balanced deficit reduction, reducing gun violence, and the implementation of the Affordable Care Act,? President Obama said.

There were already reports about two weeks after President Obama?s re-election that an Internet marketing system called Narwhal, used during the campaign, would be used to shape the public debate over the upcoming fiscal cliff negotiations.

Messina spoke at a conference hosted by Politico and described Obama for America, the operation that included Narwhal, a Dashboard program, a team of programmers, and 32,000 volunteers.

?It would be very easy for supporters today to go and start asking people to call members of Congress. ? I am sure you will see our supporters start doing that,? Messina said in November.

If Organizing for Action continues in the mold of the Obama for America, it will likely need the significant funding afforded to a 501(c)(4) group to maintain the technology behind the organization and operatives in neighborhoods to advocate for issues.

And for starters, Organizing for Action will be taking on the National Rifle Association in the battle over gun-control legislation.

But Organizing for Action is already receiving criticism from the left about its potential to raise large amounts of money without full disclosure, and its apparently conflicting role with the Democratic National Committee.

Technically, Organizing for Action would raise and spend money to advocate issues, while the DNC would raise money to directly run election campaigns.

But as the 2012 election showed, there is a lot of overlap between the two concepts, especially when it comes to leveraging an email database with 175 million names currently in the possession of Organizing for Action.

Chrome Beta update fixes issues, has a new icon

Since a proper Chrome Beta channel app came into the Play Store, we knew we'd be in for some frequent updates. Alongside a new icon that has a black/white "BETA" tag on it, rather than the angled grey/white one before, this update brings many small fixes:

  • 165783 - Enable compositing scrollable frames on Android
  • 168368 - Chrome progress bar should be displayed as soon as the user clicks a link
  • 165244 - Text handler jumps or disappears when moving
  • 162486 - iframe scrolling broken

There are still some glaring bugs, as is the case with Beta releases, such as yahoo.com page links not working and some intense graphical glitches on certain devices. This is all part of the fun though, and we know what we're getting into when moving to the Beta channel of a browser.

You can't find Chrome Beta by searching the Play Store, so if you're interested in staying on the bleeding edge of browser updates you can install it directly from the link at the top of this post.

But reports Friday that the Al Qaeda-affiliated group that carried out the Algeria hostage taking wants to exchange two American hostages for two Islamist extremists and convicted terrorists jailed in the US suggests that America can?t help but be at the center of the global battle with Al Qaeda and associated Islamist radicals.

Commenting Friday on the still-unfolding Algeria hostage crisis, Secretary of State Hillary Rodham Clinton pledged stepped-up US support for counterterror efforts in North Africa.

The proposed exchange from the ?Signers of Blood,? an offshoot of Al Qaeda in the Islamic Maghreb (AQIM), was relayed through a Mauritanian news service and underscores how radical Islamist groups have learned a cardinal lesson of Al Qaeda?s masterminds: that it serves the organization?s purposes to provoke the US and make it part of the anti-Western fight.

The group proposed exchanging its American hostages for the release of Egyptian Sheikh Omar Abdel-Rahman, serving a sentence in North Carolina for plotting to bomb New York landmarks; and Pakistani Aafia Siddiqui, who is serving a life sentence in federal prison for attempted murder of US soldiers in Afghanistan.

The US was quick to affirm Friday that it would not pursue any kind of deal with the hostage-takers. ?The United States does not negotiate with terrorists,? State Department spokeswoman Victoria Nuland told reporters.

But this position would not be news to the Algerian hostage-takers of AQIM, regional analysts point out. That means that the goal of those publicly proposing such a deal, they add, was really aimed at something else.

?It reminds me of Saddam Hussein saying he?d be happy to leave Kuwait [which he occupied in 1990] as soon as the Israeli-Palestinian conflict was settled and the Palestinians had a state,? says Patrick Clawson, director of research at the Washington Institute for Near East Policy. ?Not gonna happen, and you know it. But that?s not the point.?

There was still little clarity Friday afternoon about how many hostages remain in the hands of the Islamist militants, and how many of them are Americans. At least one American was killed in the assault, according to the Associated Press. Late Friday, the State Department confirmed the death of US citizen Frederick Buttaccio, according to a statement from Ms. Nuland.

The Algerian state news agency reported Friday that about 100 of more than 130 foreign hostages had been freed, while it claimed that more than 570 Algerians were also freed in the Algerian military?s assault, which began Thursday on the Ain Amenas gas facility in southern Algeria. Engineers less empathetic than students in caring professions, study suggests

Jan. 17, 2013 ? Are engineering students less empathetic than students in the caring professions? Yes, the findings from a study performed at Link?ping University indicate that this is the case. The study comprises more than 200 students from six different study programs and was carried out by Chato Rasoal, a researcher in psychology, together with two colleagues.

The researchers measured empathy with a well-established questionnaire that shows, for example, the degree of imagination, the ability to assume the perspective of others, and whether the subject cares about others, along with the subject?s own worries and anxiety.

"Empathy can have both a cognitive and an emotional aspect," explains Chato Rasoal. The capacity to see things from the point of view of others is primarily cognitive, while caring about others is a more emotional component.

Earlier research has shown that engineers have a lower degree of empathy than future doctors and nurses. This may seem perfectly natural, after all, you don?t need much empathy to work with machines and calculations, do you? But Chato Rasoal doesn?t agree.

- Advanced engineers often take on leading positions in companies, where they have to be able to lead teams involving many co-workers. This requires both good communication skills and social competence. In today?s global business world you also need intercultural competence, an ability to communicate and collaborate with people from entirely different cultures.

The students responses evinced clear differences between caring-profession students and engineers. The latter had considerably lower scores. However, the differences were mitigated when the data was adjusted for gender. It?s well known that women are more empathetic than men.

Two groups of engineers participated, students of computer engineering and applied physics. For the latter a marked difference compared with caring students remained even after adjusting for gender differences.

For computer engineering students, the differences were largely eliminated. The researchers have a theory about why: the computer engineering students are taught with PBL, problem-based learning, which is not the case for the applied physics students. Chato Rasoal believes this can influence the degree of empathy.

"In problem-based learning you work in groups a lot. You have to be able to listen to others and accept other people?s thoughts and expressions of emotions. Otherwise it won?t work."

In a currently ongoing study they want to see if this theory can be confirmed. For five semesters they have followed students of computer engineering to see whether PBL affects their capacity for empathy. The data are now being processed.

U.S. Republicans weigh short-term debt limit increase

WILLIAMSBURG, Virginia (Reuters) - House Republicans signaled on Thursday they might support a short-term extension of U.S. borrowing authority next month so they can move on to budget battles that could offer them more political leverage.

The move, described as under consideration by House of Representatives Budget Committee Chairman Paul Ryan, appears to be aimed at getting President Barack Obama and his Democrats to start negotiating with them on spending cuts without Republicans being blamed for a debt default and any resulting chaos in financial markets.

"We're discussing the possible virtue of a short-term debt limit extension, so that we have a better chance of getting the Senate and White House involved in discussions in March," said Ryan.

The option, if successful, would put off a fight with Obama over a long-term debt ceiling increase until Republicans and the White House have negotiated their way through two other fiscal deadlines later in the spring.

It follows Obama's refusal to drawn into a negotiation over the debt ceiling. Republicans had hoped to use it as a lever to extract spending cuts from the White House.

Ryan, the party's failed candidate for vice president last year and a likely presidential contender in 2016, spoke to reporters during a retreat of Republican House members in Williamsburg.

The Republican approach - which has not been finalized - would effectively rearrange three looming deadlines in the long war between the parties over deficit reduction.

The first of the fiscal deadlines, the exhaustion of federal borrowing capacity, will happen sometime between mid-February and early March. A failure by Congress to raise this debt ceiling could result in a market-rattling government default.

The second deadline, the delayed launch of automatic spending cuts that were part of the "fiscal cliff", will occur on March 1. A third deadline comes on March 27, when Congress must enact new funding for government agencies and programs.

Ryan did not specify how large the debt ceiling extension would be and how long it would last given the current budget deficit.

THREE-MONTH EXTENSION?

Obama has vowed not to negotiate over the debt limit, saying that Congress must simply raise it to ensure that past spending obligations are met. Democrats are attempting to brand any attempts to use it for bargaining leverage as reckless.

Ryan stopped short of threatening to push the country into default if the party's spending cut demands are not met.

But he said Republicans were now considering the best approach to use their leverage over looming fiscal deadlines in February and March to reduce deficits.

"We believe that it would be wrong if we walk out of this spring with no achievement on debt reduction whatsoever because that will hurt the country, that will hurt the economy," Ryan said.

Representative John Fleming of Louisiana said a debt limit extension that would last at least three months was under discussion. The idea would be to create some breathing space so that Congress could negotiate over automatic spending cuts and a new government funding measure.

Asked if he was willing to "shoot the hostage" and allow the United States go into default if Democrats resist spending cut demands, Ryan said he was not willing to "use any metaphors like that at all."

There are 35 newly elected Republican members who did not participate in the grueling fight over the debt limit in 2011, which pushed the United States close to a default, roiled financial markets and prompted an unprecedented credit downgrade from Standard and Poor's.

Some of these members have said they would be willing to force a government shutdown if their demands for reduced spending are not met. If the debt limit is not raised, the government may start to halt some operations to preserve its cash for debt repayments.

Ryan said he supports this kind of prioritization of payments and would be willing to take legislative steps to make it "crystal clear" that the administration has authority to choose among its payment obligations.

The Treasury resisted this in 2011, saying that any missed payment, whether for Social Security benefits or for cleaning supplies, was a technical default.

The duration of a debt-ceiling increase depends on its size. In December 2009 the Treasury Department sought an increase of $1.8 trillion that it calculated would enable borrowing beyond the November 2010 elections.

Congress responded with a $300 billion increase that carried the government only for another three months.

In the past, Obama has threatened to veto such limited extensions. If he were to do that, however, or if the Democratic-controlled Senate were to reject a short-term increase passed by the Republican-controlled House, Republicans could then try to blame the Democrats for a default.

Fitch Ratings warned this week that it could cut the country's top credit rating even if the Treasury prioritized U.S. debt payments to avoid default. But Ryan said that the rating agency also pointed out that it was crucial to reduce the U.S. debt burden.

"We know we have a debt crisis coming, this is not an if question, it's a when question," Ryan said.

GOINDUSTRY DOVEBID SA (PTY) LTD ONLINE AUCTION TERMS & CONDITIONS ? MOVEABLE ASSETS

By participating in this Online Auction, you consent to be bound by these terms and conditions in addition to our general terms and conditions as well as any additional terms that may be imposed by the seller or announced at the auction, included within the Notice to Purchasers, Rules of Auction and/or set forth on individual asset lot pages.? For the purposes of these terms and conditions, we refer to any person or entity registering to offer or offering to buy goods as a "buyer" regardless of whether any contract of sale is concluded.

1. Auctioneer's role in Online Auctions

For the purpose of the Online Auction, ?GoIndustry DoveBid SA (Pty) Ltd will be the auctioneer and agent for the seller (the "Auctioneer") and will sell goods to a buyer.

The Auctioneer may at its discretion or upon the instruction of the seller:

(a) alter or withdraw all or any lots up to the moment at which such lot(s) are indicated as "SOLD" (the "Announcement of Sale");

(b) where a reserve has been placed on any lot, withdraw that lot in the event that the highest bid price at the end of the Online Auction does not meet the reserve;

(c) bid for any lot or lots offered for sale at the Online Auction on its own account ?

(d) bid for any lot or lots offered for sale at the Online Auction on behalf of ?third parties

(e) bid for any lot or lots offered for sale at the Online Auction on behalf of sellersbut, if on behalf of sellers, not at or in excess of the reserve price; and/or

(f) combine (including in bulk), sub-divide or amend a lot or lots as the Auctioneer deems appropriate.

The Auctioneer, GoIndustry DoveBid SA (Pty) Ltd, any GoIndustry DoveBid Group Company or an Associated Auctioneer may participate as sellers in Online Auctions from time to time.

Buyers agree that GoIndustry DoveBid and/or, where applicable, the Auctioneer may at any time and from time to time without notice: (i) discontinue an Online Auction either temporarily or permanently; or (ii) extend an Online Auction beyond the period indicated on the Site.

2. Sale

Unless otherwise indicated, all lots are offered subject to a reserve, which is the confidential minimum price below which a lot will not be sold.? The reserve price may be decreased by the Auctioneer or seller at any time before or during the online auction.? The reserve price may be decreased to the level of the highest Autobid if that bid is below the current reserve price with the effect that the highest Autobid may be accepted.

Subject to the reserve price (if any) being met, each lot shall be sold to the highest bidder. All sales are final. In the event of any dispute arising between buyers such dispute shall be dealt with in such manner as the Auctioneer may in its absolute discretion determine. The Auctioneer reserves the right to resell any lot in dispute by putting it up for auction again. The Auctioneer reserves the right to rescind any sale for any reason in which case the buyer?s sole remedy shall be the refund of the amount of the purchase price and any Buyer?s Premium actually paid.

The completion of a sale shall be indicated on the Site by showing the item as "SOLD" online - if an Online Auction for a lot closes without the lot being sold, it will show as "CLOSED", if a lot is withdrawn, it will show as ?WITHDRAWN".

3. Regulation

Bidding shall be regulated by the Auctioneer in such manner as it may think fit and, without prejudice to the generality of the foregoing, the Auctioneer may without ascribing any reason therefore, refuse to accept any bid or may facilitate automatic bids on behalf of buyers during the Online Auction process.

4. Notice to Purchasers

The Site will show a separate Notice to Purchasers for each Online Auction which will stipulate a payment date ("Payment Date") for each lot in an Online Auction and the date by which the goods will have to be removed by the successful buyer ("Clearance Date" or "Removal Date") and certain other terms and conditions which form part of these Terms and Conditions.

5. Buyer's Premium

The buyer will pay to the Auctioneer such premium ("Buyer's Premium") on the Announcement of Sale as stipulated in the Notice to Purchasers for the Online Auction in question to which will be added any applicable value added tax or the equivalent or similar sales taxes in the relevant jurisdiction at the current rate. The Buyer's Premium is not negotiable and is payable by all buyers. The Auctioneer, when acting as agent for the seller, may also receive commission from the seller.

6. Buyer's obligations

(a) Payment

Unless otherwise provided for in the Notice to Purchasers for the Online Auction in question, immediately after the Announcement of the Sale, the successful buyer shall pay a 25% deposit towards the purchase price. Where applicable, buyers expressly authorise GoIndustry DoveBid and/or the Auctioneer to charge buyers? credit cards for the amount of such deposit.?If a successful buyer fails to make a timely deposit, the Auctioneer and the seller may resell the item in question without notice.? In addition, unless otherwise provided for in the Notice to Purchasers, the successful buyer shall pay the full purchase price of the lot (including in addition Buyer's Premium and any value added tax or the equivalent or similar sales taxes) to the Auctioneer on behalf of the seller (in cleared funds) on or before the Payment Date. More information about the applicable taxes may be given in the Notice to Purchasers for the Online Auction in question, however, buyers should seek their own tax advice. The buyer agrees that invoices may be issued in electronic form by email.

Payment shall be made in the currency specified on the relevant Notice to Purchasers. Any bank charges in respect of conversion or transfer of monies shall be met by the buyer. If goods are exported, tax refunds or zero rating may apply, tax refunds (if any) will be made by the Auctioneer, subject to receipt of (i) satisfactory proof of export by the buyer; (ii) the corresponding amount of tax refund from the relevant tax authority or the seller and (iii) the relevant tax forms (if applicable).

(b) Collection/Removal

Unless otherwise provided for in the Notice to Purchasers for the Online Auction in question, the buyer will:

(a) remove lots from the seller's premises during normal business hours and not later than the Clearance Date/Removal Date for the lot in question and this condition shall be of the essence of the contract;

(b) only remove lots by previous arrangement with, and subject to the supervision of, the Auctioneer or its agent(s) or appointed representative(s);

(c) not be permitted to remove any lots it has purchased from the seller's premises until all sums due in respect thereof have been paid; and

(d) be responsible for the removal and insurance of the purchased lot(s) at its own expense.

If, in the Auctioneer's opinion, removal of any lot or part thereof will be likely to cause serious damage to the seller's premises, or any other damage which the buyer is either unable or unwilling to rectify, the Auctioneer may by notice to the buyer rescind the sale of such lot or permit the removal thereof from the premises to proceed subject to such conditions as it may think fit to impose. GoIndustry DoveBid shall have no responsibility to disconnect utilities to the sold asset, including electric, gas, waste and water lines.

The buyer shall provide, or ensure that their agent(s) performing removals on its behalf, provide on demand, evidence of insurance policies reasonably satisfactory to the Auctioneer, GoIndustry DoveBid and/or the Seller.

Should any party claim possession of or title to all or part of a lot prior to its removal from the seller's premises, the Auctioneer reserves the right to rescind the sale thereof or to remove or permit the removal thereof from the seller's premises subject to such conditions as it may think fit to impose.

Should the buyer fail to comply with any of the foregoing requirements the lot or lots which have been subject to an Announcement of Sale to him or any part thereof may, without further notice, be re-offered for sale, destroyed or otherwise disposed of by the Auctioneer in any manner as it shall in its absolute discretion deem fit, and any monies paid shall be forfeited.

Without prejudice to any claims that the Auctioneer and/or the seller may have against the buyer for breach of contract or otherwise the buyer will become liable from the Clearance Date/Removal Date for all storage, security and administration expenses and the cost of and incidental to re-selling and/or otherwise disposing of uncleared items.

7. Buyer's responsibilities and conduct

The buyer will be responsible for all damage that it, its carriers or its agents may do to the property of any third party (and, in particular, to the seller's premises) in removing the lot(s) it has purchased. Should the Auctioneer consider such damage likely to occur, it may require the buyer to deposit such sum of money with the Auctioneer, by way of security for the costs of reinstating that part of the premises likely to be damaged by the removal of a lot, as the Auctioneer may require. Should the buyer refuse to deposit such monies, the Auctioneer may refuse the buyer access to the seller's premises for the purpose of collecting all or any of the lots it has purchased, or rescind the sale of such lot.

By placing a Bid on a lot, the buyer represents, warrants and undertakes that it has the authority and capacity to enter such Bid and close the transaction and that any Bid that it makes constitutes an irrevocable offer to buy the lot in question for the full amount of the Bid.

8. International statutory compliance exclusion

(a) It is expressly brought to the buyer's attention that, at the time of sale, any item of plant, machinery or equipment contained in the lot(s):

may not necessarily comply with the Occupational Health and Safety Act 1993, National Environmental Management Act 1998, Environmental Conservation Act 1989 ?or any other South African Legislation ?Regulations, Directives or their applicable laws or equivalent or similar laws in any relevant jurisdiction or; and

could contain blue or white asbestos, hazardous substances, dangerous chemicals etc. which if not handled correctly during their removal from a site could be in breach of the Environmental Conservation Act, Occupational Health and Safety Act 1993, or any other current legislations covering the use of such substances in a working environment in South Africa, Southern African Development Community (?SADC?), the UK, the EC, the United States or any other relevant jurisdiction.

(b) The buyer undertakes to:

remove, ship and use any purchased plant and equipment within South Africa or SADC ?or any other relevant jurisdiction in a way that does not contravene any relevant legislation and in full compliance with all applicable health and safety standards and regulations;

comply with all current applicable legislations in any relevant jurisdiction and reasonable instructions by the Auctioneer in relation to the removal/disposal of waste including hazardous waste.

Participants agree to comply with all applicable export or import control or related laws or regulations and not to violate any applicable local, state, national or international law, statute, ordinance, rule or regulation. Participants acknowledge that the Auctioneer is not the exporter of any asset unless expressly stated.? The Auctioneer gives no representation or warranty concerning and has not conducted any investigation to ascertain which items, if any, constitute, for example, ?Restricted Technology? for US law purposes or whose export is otherwise restricted under applicable law. The Auctioneer and the seller reserve the right to cancel or rescind any sale in an Online Transaction at any time if either of them ?determines, in its absolute discretion, that the sale does or may violate applicable export or import control or related laws and regulations.?

9. Intellectual Property Rights

The buyer acknowledges that any software or intellectual property rights attaching to a lot or lots may not be the property of the seller or capable of transfer by the seller. Neither the seller nor the Auctioneer is in any way authorising the use by the buyer of such software or intellectual property rights and any use of such software or exploitation of such intellectual property rights shall be at the buyer's sole risk.

10. Transfer of risk

Upon the Announcement of Sale the buyer shall assume all risks in and relating to such lots. The buyer is advised to effect in respect of all such risks arising thereafter any insurance it may consider necessary. The duty of the Auctioneer and/or the seller to make lots available shall be deemed performed upon Announcement of Sale even if a lot is subsequently damaged and/or part thereof has been lost.

Property and title in each lot shall not pass to the buyer until:

(a) full payment therefore has been received or (where payment or part payment is made by cheque) until the cheque(s) in question have been cleared; and

(b) each such lot has been removed from the seller's premises in its entirety.

11. As Is

All goods are sold "AS IS, WHERE IS, WITH ALL FAULTS AND WITHOUT RECOURSE". Illustrations, pictures or videos posted on the Site are for the convenience of the buyers only.
The seller, the Auctioneer and, where applicable, GoIndustry DoveBid has used its reasonable endeavours to ensure that the description of each lot(s) appearing on the Site are accurate, but the buyer relies upon such description at its own risk. Buyers should satisfy themselves prior to the sale as to the condition of the lot and should exercise and rely on their judgment as to whether the lot accords with its description at their own risk.

Subject to the obligations accepted by GoIndustry DoveBid and, where applicable, the Auctioneer under these Terms and Conditions neither the seller nor GoIndustry DoveBid nor, where applicable, the Auctioneer nor any of their respective employees or agents are responsible for errors of description or for the genuineness or authenticity of any lot and no warranty whatever is given by GoIndustry DoveBid or, where applicable, the Auctioneer, or the seller or their respective employees or agents to the buyer in respect of any lot and any express or implied conditions or warranties are hereby excluded to the greatest extent permitted by law.

12. Liability

Where the buyer loads any item of plant, machinery or equipment contained in a lot or lots to remove it from a site, neither the seller nor GoIndustry DoveBid nor, where applicable, the Auctioneer shall be under any liability whatsoever to the buyer or any third party for any damage however so caused by the removal and the buyer shall be responsible for and indemnify the seller and GoIndustry DoveBid and, where applicable, the Auctioneer against any damage or loss which the seller or GoIndustry DoveBid or, where applicable, the Auctioneer may suffer or incur in respect of loss, damage or injury suffered by the buyer's employees or any third party arising from the removal of the plant, machinery or equipment.

The Auctioneer is acting as agent of the seller in an Online Auction and is not responsible for acts and omissions of the seller or any of the seller's principals, officers, directors, employees or other agents.

13. Limitation of liability

Neither seller nor GoIndustry DoveBid nor, where applicable, the Auctioneer shall? be liable, in contract, tort (including negligence) or for breach of statutory duty or in any other way for:

1.?????? any loss arising from or in connection with loss of revenue, profits, contracts or business or failure to realise anticipated savings or profits;

2.?????? any loss of goodwill or reputation; or

3.?????? any indirect or consequential losses suffered or incurred by buyer,

arising out of or in connection with these Terms and Conditions and any of the actions or events contemplated within them or deriving from a sale of goods pursuant to them (?Relevant Events?).

The aggregate respective liability of seller or GoIndustry DoveBid in respect of any other loss or damage suffered by a buyer and arising out of or in connection with these Terms and Conditions or arising out of or in any way connected with any Relevant Events, whether in contract, tort (including negligence) or for breach of statutory duty or in any other way, shall not exceed (i) in the case of the seller, the amount of the purchase price paid by the buyer; and (ii) in the case of GoIndustry DoveBid the buyer?s premium paid by the buyer, in each case in respect of the goods which are the subject of the claim.

The Buyer undertakes to defend (by counsel satisfactory to GoIndustry DoveBid) and indemnify GoIndustry DoveBid and seller and hold GoIndustry DoveBid and seller harmless from and against any claim, demand, cause of action, liability or expense (including attorneys' fees and costs) asserted against or incurred by GoIndustry DoveBid, the seller or any third party in connection with the sale, removal, shipment or use of any purchased assets or a breach by the Buyer of these Terms and Conditions.?

Nothing in this clause shall limit or exclude liability for death or personal injury resulting from the negligence of seller or GoIndustry DoveBid or their respective employees or agents.

Notwithstanding any contrary provision in these Terms and Conditions, neither the Seller nor GoIndustry DoveBid limits or excludes its liability in respect of fraud,? or any other statutory or other liability which cannot be excluded under applicable law.

?14. Choice of Law and Venue

ALL DISPUTES RELATING TO THESE TERMS AND CONDITIONS BETWEEN PARTICIPANTS AND THE AUCTIONEER SHALL BE EXCLUSIVELY GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF SOUTH AFRICA.

PARTICIPANTS AND THE AUCTIONEER HEREBY IRREVOCABLY SUBMIT TO THE EXCLUSIVE JURISDICTION OF THE SOUTH AFRICAN ?COURTS OVER ANY CLAIMS, DISPUTE OR MATTER ARISING UNDER OR IN CONNECTION WITH THESE TERMS AND CONDITIONS OR THEIR ENFORCEABILITY. EACH PARTICIPANT ACKNOWLEDGES THAT GOINDUSTRY DOVEBID WOULD NOT PERMIT THE PARTICIPANT TO REGISTER AS A BUYER OR SELLER IF THE TERMS OF THIS CLAUSE 14 WERE NOT VALID, BINDING AND ENFORCEABLE.

Participants irrevocably consent to any process in any legal action or proceedings arising out of or in connection with these Terms and Conditions or its enforceability being served in accordance with the provisions of these Terms and Conditions relating to the service of notices. Nothing contained in these Terms and Conditions shall affect the right to serve process in any other manner permitted by the laws of the country in which service is to be effected.

If a sale consists of real property , the Participants and GoIndustry DoveBid agree, , to do all things and execute all contracting deeds, assignments, instruments, transfers and other documents as may be necessary or desirable to give full effect to the transaction in that country.

These Terms and Conditions are drawn up in the English language.? If these Terms and Conditions are translated into another language, the English language text prevails.
